§ 2.88.220. Ornamentation of graves.

    Except as provided in subsections B. and C. of this section, a grave may not be ornamented other than by a grave marker which complies with this article and flowers real or artificial, small flags, lights or seasonal ornaments, provided the items are placed in receptacles which conform to the requirements of section 2.88.300 of this article. Objects ornamenting or placed on graves which are not permitted by this section may be removed by the city, without notice to the lot owner or the next-of-kin of the person whose remains are interred in the grave.

    B.

    If a person whose remains are interred in a grave served during life as the president or vice president of the United States, the person's grave may be additionally marked, and the persons service commemorated, by the permanent installation of not more than two flags at the grave. If only one flag is installed, it must be the flag of the United States of America; if two flags are installed, at least one must be the flag of the United States of America, and the other may only be the flag of the United States of America or of the state of the person's birth. A flag may be installed only upon resolution of the city council and under the supervision of the city, if the city council is satisfied that the flag may be installed:

    1.

    Without damaging or disturbing the remains or a vault containing the remains of any person;

    2.

    Only on the grave or the lot in which the grave is contained, or, with the prior consent of the city council, on adjacent property which is owned by the city or by the city as trustee for the public; and

    3.

    On the grave or the lot containing the grave only with the consent of the next-of-kin of the person whose remains are interred in the grave or of all persons having rights of sepulture in the lot.

    C.

    If a person whose remains are interred in a grave served during life as the president or vice-president of the United States, the person's grave or the lot containing the person's grave may be fenced and planted with permanent shrubs and flowers, with the consent of the person's next-of-kin or of all persons having rights of sepulture in the lot.
