§ 12.36.030. License—Issuance.

  • A.

    Within ten days after receipt of an application, or as soon thereafter as practicable, the theatre manager will issue a license or notify the applicant in writing that the application is denied. If the application is denied, the notice will state the reason for the denial. There is no administrative appeal from the theatre manager's decision.

    B.

    The theatre manager will issue a license to the applicant if the theatre manager finds that:

    1.

    The proposed use is a licensable use under section 12.36.040;

    2.

    The proposed use will not violate the use regulations prescribed in this chapter;

    3.

    A prior license has not been issued for the requested date or dates;

    4.

    The requested date is within 12 months of the application date; and

    5.

    The applicant has not violated the terms or provisions of a license issued to the applicant within the 24-month period preceding the date the application is filed with the theatre manager.

    C.

    If a license is issued, the theatre manager will retain the license and notify the applicant in writing that the license has been issued on the conditions that within ten days from the date of the notice the applicant appear in the theatre manager's office and sign the license agreement and pay the license fee and the security deposit. If the applicant fails to sign the license agreement and pay the license fee and the security deposit within ten days after the date of the notice, the conditional issuance of the license is revoked and the application is deemed to have been withdrawn by the applicant.
