§ 6. Council-Manager form of government.

  • (a)

    The form of government of the city is the council-manager form. The mayor, with the advice and consent of the city council, appoints the city manager, who serves at the will of the council. The city council fixes the city manager's compensation. The city manager shall be appointed solely on the basis of executive and administrative qualifications, and must reside in the city during his or her tenure.

    (b)

    The city manager is the chief administrative officer of the city, responsible to the council for the efficient administration of all the city's affairs placed in the manager's charge by or under this Charter. The city manager shall:

    (1)

    Appoint and, when necessary for the good of the city, suspend or remove all appointive administrative officers provided for by or under this Charter and department heads, except as otherwise provided by this Charter.

    (2)

    Direct and supervise the administration of all departments, offices, and agencies of the city, except as otherwise provided by this Charter or by law.

    (3)

    Attend all city council meetings, except when excused by the mayor.

    (4)

    See that all laws and ordinances subject to enforcement by the city manager are faithfully enforced.

    (5)

    Prepare and submit the annual budget and capital program to the city council.

    (6)

    Submit to the city council a complete report on the finances and administrative activities of the city as of the end of each fiscal year.

    (7)

    Make reports as the city council may require concerning the operations of city departments, offices, and agencies subject to the city manager's supervision.

    (8)

    Keep the city council fully advised as to the financial condition and future needs of the city.

    (9)

    Perform such other duties as are specified in this Charter, or duties not inconsistent with this Charter as required by the city council.

    (c)

    Except for the purposes of inquiries and investigations under this subsection, the city council or its members shall deal with city officers and employees who are subject to the supervision of the city manager solely through the city manager. The city council may make investigations into the affairs of the city and the conduct of any city department, office, or agency and for this purpose may subpoena witnesses, administer oaths, take testimony, and require the production of evidence. Failure or refusal to obey a lawful order issued in the exercise of these powers is a misdemeanor, punishable as provided by ordinance of the city council.
