Chapter 5.30. GARAGE/YARD SALES |
§ 5.30.010. Definitions.
For purposes of this chapter the following definitions shall apply unless the context indicates or requires a different meaning.
"Calendar quarter." Each three-month period shall consist of a calendar quarter. A calendar quarter shall be interpreted as January through March, April through June, July and September, and October through December.
"Charitable/non-profit organization" means any organization qualifying as non-profit under Section 501(c) of the Federal Income Tax Code or the Texas Non-Profit Corporation Act.
"Garage/yard sale operator" means any person with a permit issued by the city to operate a garage/yard sale.
"Garage/yard sales" includes, but shall not be limited to, garage/yard sales, neighborhood garage/yard sales, charitable organization garage/yard sales or any designated individual or organizational yard sales, auctions, bazaars, estate sale or rummage sales which are conducted for sale of new or used merchandise at a location which is not currently zoned for such sales. Said sale includes situations in which more than five specific items of tangible personal property are to be sold.
"Inclement weather" means severe, stormy, rainy, weather brought on by the forces of nature or acts of God. Sunshine and hot weather shall not be included.
"Normal business day" means Monday through Friday, 8:00 a.m. to 5:00 p.m. excluding city-approved holidays and Saturday and Sunday.
"Person" includes individuals, partnerships, voluntary associations and corporations.
"Personal property" means property which is owned, utilized and maintained by an individual or members of his/her residence and acquired in the normal course of living in or maintaining a residence. Merchandise purchased for resale at a garage/yard sale or obtained by consignment for sale at a garage/yard sale is prohibited.
"Residence" means any single-family structure or multi-family complex which may be owned, rented or leased.
