§ 5.12.120. Regulations.

  • A.

    All solicitation on residential property, whether for a commercial or non-commercial purpose shall occur only during the time that is one-half hour after sunrise and one-half hour before sunset. This provision does not apply where the peddler is on property by express, prior invitation of the owner of the property or a person residing on the premises.

    B.

    No peddler who operates in residential areas shall be a sex offender registered with the state department of public safety or shall have been convicted of any sexual offense or any offense against a child as defined by applicable law.

    C.

    All solicitation is strictly prohibited on premises with a posted notice that solicitors are not welcome or invited. A person desiring that no solicitor (including all forms of peddlers or vendors) engage in solicitation on their premises shall exhibit, in a place near the main entrance, a sign containing the words such as "No Solicitors," "No Trespassing," or "No Vendors."

    D.

    All peddlers granted permission to solicit within the city shall prominently display the photo identification tag or other approved form of identification issued to them by either the city or other governmental agency.

    E.

    Minors must be sponsored or employed by a person, company or organization. The person, company or organization that is sponsoring the minor(s) must be responsible for controlling the behavior of all sponsored individuals.

    F.

    If claiming a non-profit status, the peddler may be required to provide documentation of such status to the planning director.

    G.

    Peddlers may not solicit in an aggressive manner.
