§ 5.04.040. Application and qualifications for permit.

  • A.

    A person must apply in writing to the city council for a permit. The application must:

    1.

    State the name and address of the applicant, or the name and address of the chief executive officer of the applicant if the applicant is an entity other than a natural person;

    2.

    State whether the application is for a class 1 or class 2 permit;

    3.

    State the date, hours and place for which the permit is requested, which may only be lawful hours on a date specified in Section 5.04.030(B) or (C);

    4.

    Certify that the applicant is twenty-one (21) years of age or older or, if the applicant is an entity other than a natural person, that all members of the applicant are twenty-one (21) years of age or older;

    5.

    Certify that alcoholic beverages will not be furnished to a person under the age of twenty-one (21) unless the person is in the personal presence of the person's adult parent, adult spouse, or other adult person into whose custody the person has been committed by a court;

    6.

    Certify that the applicant has not violated the terms of a class 1 or class 2 permit issued to the applicant within the three years immediately preceding the date of the application; and

    7.

    If the application is for a class 2 permit, be accompanied by proof that the applicant has obtained or will have obtained on the date for which the permit is requested all required licenses and permits from the Texas Alcoholic Beverage Commission.

    B.

    An applicant for a class 2 permit may only be a charitable nonprofit corporation or association or a person or group of persons hosting, sponsoring or staging a charitable nonprofit event on the date and at the place for which the permit is requested.
