§ 3.04.030. Competitive sealed bidding procedures.
If the competitive sealed bidding requirement under Chapter 252, Texas Local Government Code, applies to a purchase or contract by the city, notice of the time and place at which bids will be publicly opened and read aloud must be published at least once a week for two consecutive weeks in a newspaper published in the city. The date of the first publication must be before the fourteenth (14th) day before the date set to publicly open the bids and read them aloud. The purchasing agent shall, in addition, solicit sealed bids from all prospective suppliers located within the county and from other prospective suppliers whom the purchasing agent reasonably believes would be interested in bidding, by sending them a notice of the project. All bids received will be opened at a meeting of the city council and read aloud at the meeting. Bids will be open to public inspection for at least forty-eight (48) hours before any award is made; the city council may suspend the public inspection period if it determines that an immediate award is in the best interest of the city. In giving notice inviting sealed bids, the city reserves the right to reject any and all bids. If the contract is awarded, the city council must award the contract to the lowest responsible bidder. The bidder to whom the contract is awarded must execute a good and sufficient bond which meets the requirements of Section 252.044, Texas Local Government Code, or Article 5160, Texas Revised Civil Statutes.
