§ 2.88.450. Contributions—Amount required for perpetual care and upkeep of individual lot or grave.
A.
A person, association, or corporation may contribute or donate money or property to the city for the care and upkeep of the cemetery generally, or for the care and upkeep of a particular lot or grave. If property other than money is donated, the city shall have the right to liquidate the property, in its discretion, notwithstanding any contrary provision contained in the terms of any donative instrument.
B.
A person desiring the city to act as trustee for the person or for deceased persons in whom the person has an interest may deposit with the city the sum of one hundred fifty dollars ($150.00) per square space, which shall constitute a permanent and perpetual trust fund for the care and upkeep of the grave space or spaces designated by the person. Upon deposit of such sum, the city secretary shall issue to the depositor a certificate stating the purpose and amount of the deposit, the name of the depositor, the location, as nearly as possible, of the grave or graves, and any additional information deemed necessary or proper by the city.
C.
The city secretary shall maintain a permanent record in alphabetical order of all depositors, which record include the amount and purpose of the deposit, names and locations, insofar as possible, of graves, the condition and status of the trust imposed, and any additional information the city may deem necessary or proper.
