§ 12.16.020. Signs above or across streets and sidewalks.

  • A.

    It is unlawful for any person to erect or suspend on, across or above the sidewalks, streets, or alleys of the city, any kind or character of sign which projects out from the building line for distance greater than six inches; provided that temporary cloth signs, illuminating electrical signs and enclosed revolving signs are permitted for a period not to exceed one month when attached to a building and they do not project beyond the building line for a distance of more than 12 inches.

    B.

    Cloth signs suspended over a street, alley or public property ("banner signs") shall be not less than 20 feet above the street, alley or ground surface at the lowest point, and shall be suspended by ropes. No metal shall be used in the construction of the sign or in the apparatus supporting same. Cloth signs shall not be allowed to hang more than two consecutive weeks and may be permitted and authorized only as follows:

    1.

    Banner signs may be used and installed only for the following purposes:

    a.

    Advertising celebrations, expositions, fairs, excursions and events sponsored by non-profit community organizations, and non-profit societies and clubs of public character within the city limits;

    b.

    Advertising celebrations, expositions, fairs, excursions and events sponsored by governmental entities within the city limits; and

    c.

    Providing notice of programs and events scheduled by a church or school within the city limits.

    2.

    Banner signs may be erected and installed only by authorized city personnel;

    3.

    A city permit is required prior to scheduling the placement or erections of the sign;

    4.

    Permit applications must be made at least 30 days prior to the date requested for placement or installation in order for the city to schedule the installation;

    5.

    Permit applications must include the required permit fee and specify the length, width, the proposed location of the sign and exact wording of the sign;

    6.

    The permit fee shall be $125.00, inclusive of the expense to install the sign; and

    7.

    Banner signs shall not be used to advertise or promote a private business or interest unless said business is a sponsor of the celebration, exposition, fair, excursion or event which is being promoted. The advertisement of the private business sponsor may not exceed 25 percent of the banner.

    C.

    A banner sign permit may be issued for a period of up to 12 months in which time the sign may be installed not more than six times, and permitted to remain in place for not more than two consecutive weeks each time it is installed. A permit that allows a banner sign to be installed more than once during the authorized permit period shall specify the specific dates for which the sign shall be authorized to be installed and remain in place during the permit period. The permit fee of $125.00 will be applied for each date the sign is to be installed during the permit period.
