§ 12. Effect of master plan.

  • Upon adoption of the master plan by the city council, no subdivision, street, park nor any public way, ground or space, public building or structure and no public utility, whether publicly or privately owned, which is in conflict with the master plan, shall be constructed or authorized by the city until and unless the location and extent thereof shall have been submitted to the planning commission and the city council for its approval or disapproval. The planning commission shall communicate its reasons for approval or disapproval to the city council, which shall have the power to approve or disapprove such change and to amend the master plan. Upon the city council approving a change and amending the master plan, the officer, department, agency or other applicant shall have the power to proceed. The widening, narrowing, relocating, vacating or change in the use of any street, watercourse, or other public way or ground or the sale of any public building or real property shall be subject to similar submission and approval. The planning commission's recommendations may be overruled by the city council. The failure of the planning commission to act within thirty (30) days after the date the proposal is first submitted to the planning commission at a meeting at which a quorum is in attendance, and for which an appropriate agenda item is posted in compliance with the Open Meetings Act, shall be deemed approval by the planning commission, unless a longer period be granted by the city council.
