§ 7. Upgrading the system.

Latest version.

(a)

Company shall, within eighteen (18) months of effective date of this franchise, upgrade the system to a minimum of 400 MHz.

(b)

Company shall offer and provide FM radio service.

(c)

At the completion of the system upgrade to 400 MHz, and before any new channels are added to the upgraded system, a customer survey shall be performed by Company to determine the programming interests of the subscribers. City shall have the opportunity to review the survey material prior to implementation by Company. Company will provide City with a summary of the survey results.
