§ 6. Area to be served.
(a)
The area to be served by Company is the entire City. Company shall provide service to every dwelling and building requesting cable service within sixty (60) days of the request, provided said dwelling or building is located within City boundaries on the date this ordinance is adopted.
(b)
For future subdivisions or newly developed areas annexed by the City after the date this ordinance is adopted, Company agrees to and shall extend the cable system to serve such subdivisions or areas as they are completed, provided that Company is able to obtain from property owners any necessary easements and/or permits at no cost in order to provide such system extension. However, for unusual circumstances, such as a Subscriber's request to locate his cable drop underground, existence of more than 150 feet of distance from distribution cable to connection of service to the dwelling unit(s), or a density of such subdivisions or areas of less than 35 completed dwelling units within one linear mile of Company's trunk or distribution cable, service may be made on the basis of a capital contribution in aid of construction, including cost of material, labor and easements. Subscribers who request service hereunder will bear the remainder of the construction and other costs on a pro rata basis. Company may require that the capital contribution in aid of construction borne by such potential subscribers be paid in advance.
