§ 11. Access channels.

  • (a)

    Company's system shall reserve four (4) channels for public, educational, and governmental access use. Initially, only three (3) access channels need be activated, one each dedicated to governmental, educational, and community access. At such time as City has commitments from enough community access users to insure a minimum often (10) hours per month of original programming on a continuing basis, Company agrees to make available the fourth channel upon sixty (60) days notice. Provided, however, Company shall have no obligation to provide more than four (4) access channels. If access channels are not provided on the basic level of service, they shall be provided on the next level of service.

    (b)

    Government, community, and educational programming shall be noncommercial and nonprofit in nature and shall contain no commercial advertising.

    (c)

    Company shall provide the transmission capability to enable two-way communications from three (3) sites, one (1) each selected by City, Uvalde Consolidated Independent School District, and Southwest Texas Junior College. A pre-condition of the activation of any such site shall require that the entity demonstrates to City and Company the need for activation, and furnish its operating plans. Upon completion of the upgrade, as set forth in Section 7 of this ordinance, Company shall activate the two-way connection to the entity within six (6) months of notice by City.

    (d)

    Company shall be allowed to utilize the access channels for such other purposes as it may deem appropriate whenever the users are not utilizing these channels. Whenever any access channel is utilized less than an average of six (6) hours per seven-day week for a period of one (1) year following the activation of said channels, reassignment to Company use shall be considered.

    (e)

    Company shall provide to City on City's request a capital contribution of $25,000.00 for public, educational, and governmental access purposes. Company shall assist City in the selection of public, educational, and governmental access production equipment.
