§ 8.12.040. Violation—Penalty.

    A person commits an offense if the person knowingly or intentionally violates Section 8.12.030 of this chapter.

    B.

    An offense under this section is punishable by a fine not to exceed $500.00.

    C.

    Each day that a violation occurs or continues constitutes a separate offense.

    D.

    A peace officer may seize illegal fireworks. Fireworks seized under this section shall be kept in the custody of the chief of police. The owner of the seized fireworks may file an action contesting the seizure in the district court of the county within 30 days after the seizure. If an action contesting the seizure is not filed within that time, or if an action is timely filed unless upon final hearing the court orders the return of the seized fireworks, the chief of police shall destroy the fireworks.
