§ 13.16.025. Bulk purchases of potable water.
A.
Residents of the city and nonresidents of the city who reside in Uvalde County may purchase potable water in bulk at the City Service Center for household use, subject to water availability in accordance with the rules, regulations and limitations set forth in this section.
B.
The following rates for the purchase of bulk potable water shall apply:
1.
Residents of the City. Bulk potable water rates for city residents shall be $1.00 per 250 gallons. The resident is responsible for providing a container approved for potable water use only and for providing for transportation of the water.
2.
Nonresidents of the City. Bulk potable water rates for nonresidents of the city that reside within Uvalde County shall be $2.00 per 250 gallons.
C.
Rules and Regulations Governing the Sale and Purchase of Bulk Potable Water.
1.
Only residents of the city and nonresidents who reside in Uvalde County may purchase bulk potable water under this section.
2.
Before a purchaser may purchase bulk potable water under this section, a purchaser must demonstrate an emergency need for the purchase of bulk potable water.
3.
Prior to the purchase of any bulk potable water, a purchaser shall execute a purchase request form, which shall be made available at the City Service Center, that sets forth the following:
a.
The residency of the purchaser;
b.
A description of the emergency need which shall be supported by providing sufficient proof and verification of the loss or impairment of the purchaser's normal drinking water supplies or sources through no fault of the purchaser.
c.
A purchaser may also provide any other basis that the purchaser believes constitutes an emergency need and necessity to purchase bulk potable water under this section, subject to the approval of the city manager or his or her designee.
d.
The city manager or his or her designee may require additional or supplementary documentation and other written verification of any claimed emergency need or necessity.
4.
A purchaser is required to provide a container approved for potable water use only and a purchaser is responsible for providing for transportation of the purchased water.
5.
A purchaser of bulk potable water shall be responsible for ensuring the continued potability of any water purchased from the city.
6.
All bulk water purchased pursuant to this section shall be for household use only which shall be defined as a use of water by an individual or a household to support domestic activity; such use may include water for drinking, washing, or culinary purposes only.
7.
Bulk water purchased under this section may not be resold nor may a purchaser purchase potable bulk water from the city for the purpose of resale.
8.
A purchaser may purchase no more than 1,000 gallons of potable bulk water from the city per month unless authorized in writing by the city manager.
D.
The city manager may limit the amount of bulk potable water available for sale to any purchaser or may prohibit the sale of bulk potable water to any purchaser:
1.
If the purchaser fails or refuses to demonstrate the required emergency need or necessity; or
2.
When necessary in order to comply with the city's current drought contingency and water conservation plans.
