§ 10.32.200. No parking zone—Portion of Coyote Trail.

    Definitions. As used in this section the following terms shall have the meaning and definition as follows:

    Middle Lane. Coyote Trail has three lanes from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas, and one of the lanes is the north side of Coyote Trail and another of such lanes is on the south side of Coyote Trail and the lane in the middle of the north and south lanes is the "middle lane" of Coyote Trail.

    "Motor vehicle" means a vehicle that is self-propelled.

    "No parking zone" means an area of a street that has been designated by the City of Uvalde, Texas, where no vehicle can be parked or left standing.

    "Owner" means a person who:

    1.

    Is registered as the registered owner holding legal title of a vehicle;

    2.

    Has the legal right of possession of a vehicle; or

    3.

    Has the legal right of control of a vehicle.

    "Vehicle" means a device in, on, or by which a person or property is or may be transported or drawn on a public street or public highway. The term includes, but is not limited to, a motor vehicle, truck-tractor, semi-trailer, truck-tractor and semi-trailer or a trailer.

    B.

    Designation of No Parking Zone—South Side. The City of Uvalde, Texas, designates and establishes a no parking zone on the south side of Coyote Trail from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas. The no parking zone shall be marked by signs showing NO PARKING.

    C.

    Designation of No Parking Zone—Middle Lane. The City of Uvalde, Texas, also designates and establishes a no parking zone in the middle lane of Coyote Trail from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas. The no parking zone shall be marked by signs showing NO PARKING.

    D.

    No Parking—South Side. It is unlawful for any person or owner to park or leave standing a vehicle on the south side of Coyote Trail from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas.

    E.

    No Parking—Middle Lane. It is unlawful for any person or owner to park or leave standing a vehicle on the middle lane of Coyote Trail from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas.

    F.

    Prima Facie Evidence. In any prosecution charging a violation of this section governing the standing or parking of a vehicle, proof that the particular vehicle, described in the complaint was parked in violation of this section, together with proof that the defendant named in the complaint was, at the time of such parking, the owner of such vehicle, shall constitute in evidence a prima facie presumption that the owner of such vehicle was the person who parked or placed such vehicle at the point where, and for the time during which, such violation occurred.

    G.

    Towing and Removal—South Side. Any vehicle which shall be or remain standing or parked on the south side of Coyote Trail from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas, in violation of this section, the owner or driver of which vehicle has been given a citation for parking or leave standing such vehicle in violation of this section, may be removed by or upon an order by a police officer. The owner of such vehicle shall be responsible for the payment of any fees incurred for the towing and/or storage of such vehicle.

    H.

    Towing and Removal—Middle Lane. Any vehicle which shall be or remain standing or parked on the middle lane of Coyote Trail from its intersection with Mary Ann to its intersection with North Second Street in the City of Uvalde, Texas, in violation of this section, the owner or driver of which vehicle has been given a citation for parking or leave standing such vehicle in violation of this section, may be removed by or upon an order by a police officer. The owner of such vehicle shall be responsible for the payment of any fees incurred for the towing and/or storage of such vehicle.
