Article II. No Parking Zones |
§ 10.32.160. No parking zone—Portion of North Mueller Street.
A.
Definitions. As used in this section the following terms shall have the meaning and definition as follows:

"Motor vehicle" means a vehicle that is self-propelled.
2.
"Vehicle" means a device in, on, or by which a person or property is or may be transported or drawn on a public street or public highway. The term includes, but is not limited to, a motor vehicle, truck-tractor, semitrailer, or a trailer.
3.
"Owner" means a person who:
(a)
Is registered as the registered owner holding legal title of a vehicle; or
(b)
Has the legal right of possession of a vehicle; or
(c)
Has the legal right of control of a vehicle.
4.
"No parking zone" means an area of a street that has been designated by the city, where no vehicle can be parked or left standing.
B.
Designation of No Parking. The city hereby designates and establishes a no parking zone on a certain designated area on the north side of Mueller Street and the certain designated area is located between ninety eighty (98) linear feet to one hundred sixty (160) linear feet from the northeast intersection of North Park Street and Mueller Street sidewalks in the city. The no parking zone shall be marked by signs showing NO PARKING.
C.
No Parking. It is unlawful for any person or owner to park or leave standing a vehicle on the designated area which is located between ninety eight (98) linear feet to one hundred sixty (160) feet from the northeast intersection of North Park Street and Mueller Street sidewalks in the city.
D.
Prima Facie Evidence. In any prosecution charging a violation of the ordinance codified in this chapter governing the standing or parking of a vehicle, proof that the particular vehicle, described in the complaint was parked in violation of this chapter, together with proof that the defendant named in the complaint was, at the time of such parking, the owner of such vehicle, shall constitute in evidence a prima facie presumption that the owner of such vehicle was the person who parked or placed such vehicle at the point where, and for the time during which, such violation occurred.
E.
Towing and Removal. Any vehicle which shall be or remain standing or parked on the designated area which is located between ninety eight (98) linear feet to one hundred sixty (160) linear feet from the northeast intersection of North Park Street and Mueller Street sidewalks in the city, in violation of this chapter, the owner or driver of which vehicle has been given a citation for parking or leave standing such vehicle in violation of this chapter, may be removed by or upon an order by a police officer. The owner of such vehicle shall be responsible for the payment of any fees incurred for the towing and/or storage of said vehicle.
