§ 8. Action on petition.

  • (a)

    Within thirty (30) days after the date an initiative petition has been certified to the council as sufficient, the council shall:

    (i)

    Adopt the proposed initiative ordinance without any change in substance; or

    (ii)

    Repeal the referred ordinance; or

    (iii)

    Call an election on the proposed or referred ordinance.

    (b)

    If council shall not adopt or repeal the ordinance, as applicable, the election on the proposed or referred ordinance shall be held on the next available uniform election date after the date of the council's action and for which notice may be timely given in compliance with state law and this charter. Such election may coincide with another special or a general city election should an election fall within the specified time.

    (c)

    Special elections on initiated or referred ordinances shall not be held more frequently than once each six (6) months and no ordinance substantially the same as a defeated initiative ordinance shall be adopted by the council or initiated within two (2) years after the date of the election. No referred ordinance repealed at an election may be readopted by the council within two (2) years from the date of the election at which such ordinance was repealed. Copies of the proposed or referred ordinances shall be made available at each polling place.
