§ 20. Limitation on power of council between election and qualification of new council.

  • It shall be unlawful for the existing city council between the time of the regular election for officers and the qualification of the members of the newly elected council to pass any ordinance or resolution whereby any appropriation of money is made or any obligation or contract on the part of the city is sought to be created or any franchise or privilege is granted or attempted to be conferred and any such action, appropriation, or ordinance or resolution in regard thereto shall be illegal, unauthorized, void and of no force and effect; provided, however, that nothing herein shall prevent the city council from passing any such ordinance or resolution or making such appropriation or creating such obligation or granting such franchise or special privilege if a majority of the old city council has been re-elected to, or will be members of, the new city council and further provided that the prohibitions hereof shall be suspended in case of public calamity or grave emergency.
