§ 10. Indemnity.

The Telephone Company shall indemnify and hold the City harmless from all costs, expenses (including attorney's fees) and damaged to persons or property arising directly or indirectly out of the construction, maintenance or operation of the Telephone Company's facilities located within the public rights-of-way found to be caused solely by the negligence of the Telephone Company. This provision is not intended to create a cause of action or liability for the benefit of third parties but is solely for the benefit of the Telephone Company and the City.
